Sexfist Live Performance Recording Policy
I. Recording
A. Audience recording is permitted at all Sexfist shows.
B. The policy of a particular venue, event, or festival will override Sexfist’s customary recording policy. Make sure to obtain permission from the venue, event, or festival BEFORE recording a Sexfist performance.
C. All recording is limited to audio only. Soundboard patches may be available with permission from the venue soundboard operator. Video recording is only allowed with express permission from Sexfist.
D. Persons recording (“Recorders”) are permitted to bring use multiple microphones, but space for the audience will override space for Recorders’ microphones (see section F below).
E. Any and all recording will be permitted on a space-available basis.
F. The enjoyment of the audience in attendance at a concert always takes precedence over recording efforts. At no time may Recorders ever require other patrons to be quiet or otherwise interfere with their enjoyment of the show.
G. All Recorders must upload a copy of their recording to the Sexfist account at Archive.org. If such an upload is impossible due to technological limitations, please contact Sexfist at contact@sexfist.net for further instructions.
II. Duplication
A. All participants in audio recording exchange (regardless of format) hereby acknowledge and respect the copyrights and exclusive ownership of the music and performances by the performers, writers and publishers.
B. All recording must be for personal use only, which may include trading (via analog
or digital tape, CD, or digital file transfer). Recordings may be traded only for an equivalent amount of similar media (cassettes or CDs, pre-recorded or blank). Like other items bearing Sexfist's intellectual property, Sexfist's tapes, CDs, videos or other media may not be displayed or distributed at or around concert venues, and may be subject to seizure if found. Regardless of any expenses incurred, no money may ever be exchanged as part of a trade; however, stamped, self-addressed envelopes may be included with blank media. In addition, the media by which audio trading is published may not be commercialized. Therefore, newsletters, web sites, clubs, or any other communication forum facilitating audio trading cannot accept advertising, offer links for compensation, exploit databases compiled from their traffic, or otherwise derive any commercial proceeds in any form. Stores or businesses may not offer to duplicate Sexfist media for customers or sell or otherwise provide media containing unreleased Sexfist music for any price. A statement of compliance with this policy must be clearly posted on all web sites engaged in trading activity.
C. If Sexfist has chosen to offer for sale (via physical media such as CD, or via digital transmission or any media format now known or hereafter devised) a particular Sexfist performance, this "official" version will take precedence over amateur recordings being offered for download. In these instances, we require that digital audio repositories remove any recording of these particular performances from their collections within three (3) days of the official release or three (3) days of Sexfist’s announcement of the intention to release, which ever is earlier. Notwithstanding the above, Sexfist reserves the right to require immediate removal of any unreleased Sexfist material. It is the responsibility of the site host to remain informed of the current list of Sexfist's officially-released recordings and to maintain its site accordingly. In no case may any officially-released Sexfist recording (live or studio) be duplicated or otherwise traded or offered. Broadcast of unreleased Sexfist recordings via radio or online is permissible only if it conforms to all the guidelines applicable to other forms of duplication.
D. Recording at Sexfist concerts is authorized for non-commercial purposes only. Unauthorized sale, duplication and/or distribution is strictly forbidden. All Sexfist performances and recordings are the exclusive property of Sexfist. All rights reserved. The privileges to record Sexfist performances set forth in this policy constitute an express, revocable license. We reserve the right to withdraw our sanction of recording, tape trading, and/or non-commercial digital audio file transfers on a case-specific basis or in general, as we deem necessary. No waiver of any copyright or trademark right is intended.
